Downloading Anime

http://www.darkmirage.com/stuff/letter.pdf

read, wowie, this happened in singapore, my home country..

It’s amusing how these companies managed to get your private and confidential data… Let’s hope this doesn’t hit North America, and for all of you out there to be careful.

To quote chang xing, downloading anime is like jaywalking, just don’t get caught. same with cheating. lol

In my home country companies don’t have the right to get our private data and all private data is held by operators and they have refused to give it. Lol. Only police can have that data (there have to be heavy reason if police can have that data) and it has done so only 1 time and that was not because 1 person was downing next ep of love hina. It was because insult case.

Well “technically” we’re downloading .torrent file which is legal.

So.. how is it “your downloading illegal files” has anything to do with .torrent files?

Unless your downloading from a Direct Download Link then yeah, your screwed.

Any lawyers want to explain if this letter is right or just delusional?

I’ve always wondered what the legal side of subbing was, state side at least. do they care? with all the torrent sites and direct download sitesyou can find it just seems like they are allowing it to create hype for the anime for the eventual relase. and i’ve been to a few sites that have actually stopped an entire series from being downloadable because they were asked to stop by the licensing company.

so in general i’m just confused about it in general

well, fansubbing have being away for anime companies to try out new animes before licensing them in North America, where I am from. The legality of fansubs have never being formally challenged in court in my knowledge; anime companies have basically turned a blind eye, some would say, to fansubs. Though there have being one case when Media Factory Inc.(MFI) told AnimeSuki and other fansub groups to halted any MFI works present and future. However, fansubbers have justified on the premise, the “free attention” an anime will get before it gets licensed here in North America. But many Japanese anime companies are banding together against fansubs, sort of like the music industry. Read more at
    http://en.wikipedia.org/wiki/Fansub#Legal_and_ethical_issues

The original question is .torrent file legal or not. .torrent is legal since its a mean of transmit information accross the net, however what kind of files one use .torrent for is another question.

P.S. I believe fansubs and their fans need to band together to have more leverage on the anime industry.
Most anime people I know is hardcore anime fans, who buys the collector’s edition when the anime companies out them out. The future of the anime industry will eventually turn against free fansubs as anime becomes more popular. However this may not be for a while, but an ounce of prevention is worth a pound of cure.

You should move to Russia, there is no such a thing like copirights =P

  12. someone June 9th, 2007 5:43 am

hahahaha adobe sent me a letter because i downloaded some of their programs, i sent a mail back. “as you may or not be aware of, according to norwegian law ,tracking of ip is highly illegal and may result in 3-4 years in prison due to a violation to someone privacy, since adobe is a company a law sew is more likely. a
Adobe sent me the letter concerning my downloads, indicates that adobe has not contacted the police concerning this matter, and adobe has violated the law towards me, and therefore your evidence will no longer be accepted by the law. So i suggest you leave this matter alone, or i will take this matter to court.”

HAHA never heard from them again.

  13. Rollant June 9th, 2007 8:49 am

    Jcop, you’re wrong.
We, russians, do have copyright, and starting from 2008 we even will get our own DMCA :-(

    P. S. Don’t read newspapers before dinner (Soviet proverb)

  14. Zhaf June 9th, 2007 9:05 am

    @Jcop

Why didn’t you say you should move to africa. Africa has absolutely no copyright whatsoever too, no?

  15. shimazaku June 9th, 2007 5:22 pm

I believe russia is a far better contry that africa don’t you think , africa is the last place I will go on earth it is far too hot !!!

  16. Honya-chan June 10th, 2007 1:17 am

Africa is big place and not every place in there is 2 hot.

  17. Azure Flash June 10th, 2007 12:37 pm

Yes, but Africa is full of diseases and wars. Seriously, all the new, nasty stuff comes from this continent : Nile virus and AIDS, to name only those.

Besides, heat isn’t really an issue when you have an air conditioner like I do =3

  18. Gnathonic June 10th, 2007 2:28 pm

Everything in that list has been licensed in America and were big enough to probably have in many other a place as well… I think according to that list the unsaid rule of “nobody cares if it’s unlicensed since we weren’t selling it to you anyways” is still the case. Download unlicensed anime… just don’t download what they are trying to sell, or are officially going to try to sell in your country.

  19. veg June 10th, 2007 7:09 pm

i have to say it dumb to go after downloaders of anime its not like they are selling it i can see people going after the one the distribute. all the people i know that download it own or plan to own the dvds and download it because they can get it yet or they just kill the anime when it gets dubbed

  20. stormie June 11th, 2007 4:13 pm

I don’t understand whats the big deal in downloading anime and tv shows, there both the same, they should be glad other countrys enjoy their anime. Its like a vcr pushing record button. Sure in hell not going to spend $30 for a set of 4 episodes of my fav anime in amercia, greedy basterds. Gosh, japan is starting to sound like usa, with mpaa and riaa crap. Its probably because of those dam itune stores, where they offer episodes like of tv shows, where they charge you $$ for each episode. Never downloaded one myself anyway. Ya, i can see it all now@.!. I find that funny though, don’t see how its illegal to download a Torrent file. while its not the actual episode. I can understand if its direct downloads, but not torrent though.

Anyway isn’t it practically the same, downloading vs. the VCR?. Your going to find another way of doing it if its baned or not. Our country’s are getting more retarded by the second.

I don’t see any harm in fansubbing , or maybe duno, only see harm towards the dam english license anime companies people, not like we are going to buy their horrible dubbed anime, some are ok like an 1/8 of it, not all are!.

Ever noticed how popular american tv shows are? They over +100k mark easily. I’m suprised I havent heard any complaints about regular tv shows or maybe they did i dont know, just saying. Sorry for the long rant ^_^.

  21. stormie June 11th, 2007 4:16 pm

another thing, is lot of these animes get popular cause of the fansubs, and then the license companies see that, they take advantage of it. I’ve always thought that http://anidb.info/ is being moderated by them[license companies]?. I’m surprised it isnt. Cause it gives like how popular anime is , votes and ratings, then companies would take a peek and license it, get my drift ^_^.

  22. Mick June 12th, 2007 10:49 am

Also, Africa is not a country.

  23. Antipanda June 12th, 2007 7:42 pm

Wow thats kind of intense .. I hope you all keep up the good fight .. and keep subbing away. Keep up the great work.

  24. animebuzz June 13th, 2007 1:54 am

If Japanese or USA companys have a problem with fansubbing then why dont they do them there selves and charge $.35 an episode or $5.00-$10.00 a month and make there own netstation aka a channel on the net where they play there anime and ownly there anime with subs its not that hard but they go after the little people and soon people will not buy there stuff for what they did to there fans sad world isnt it. -_-

Thanks for reading may have some typos ownly had 2mins

  25. new June 13th, 2007 3:33 pm

  27. Schthaxe June 15th, 2007 2:57 pm

Hi guys hello from Russia. Copyright issues here are not so bad as one might think reading news. some animes (though very little amount) such as chobits or studio ghibli releases sells under license, with professional dub, for ~$10/dvd. All sites that has free ddl of licensed stuff (music or films) was forcedly closed almost some years ago. But p2p nets are far away from layers here ^_^ at least at the moment.

  28. Logan June 16th, 2007 6:59 am

how can i find out what animes are licensed in my country? There is no dvd release so my thought is there is no anime license here. but maybe i’m wrong…

  29. blurbear June 16th, 2007 11:06 am

did you stop subbing because of that letter???
or are these just delays cause of lack of staff or sumthin,
Really appreciate your work, kaibutsu oujo is one of my favorites,

  32. Anonymous June 18th, 2007 9:10 am

just to point this out, africa is a continent…

  33. mahsah June 18th, 2007 11:47 am

Any progress on Kaibutsu Oujo? It’s almost been a month since last release…

Just wondering at what point you are (timing, TL, typesetting, etc)

  34. Mr. I.C.E. June 19th, 2007 1:11 am

Are u guys/girls still subbing KO? I really like your subbing and would like to see more

  35. Ripman June 19th, 2007 4:04 am

Ok i may be asking a dumb question that been already asked.

Is this going to hinder your fansubbing?

  36. endaene June 20th, 2007 7:40 am

“not like we are going to buy their horrible dubbed anime, some are ok like an 1/8 of it, not all are!.”

I pretty much agree on that thought. Paying $20 for a DVD with like 2-4 episodes on it is a bit steep, especially since, if we lived in Japan, we could watch it as it airs for the cost of Cable… which I’m pretty sure is less than the broadband it takes to download it conveniently. Considering that the reason its priced so high is the licensing company had to pay american voice actors for a mediocre, half-assed dub, it seems only natural to cut out the middle-man. And of course, on the off chance an anime makes it onto OUR cable network, it’s definitely going to be the dubbed version, and have many jokes cut simply because they don’t think we’ll understand them. Umm, well, I guess I went off on a rant, and on a fairly long dead argument. oh well. It’d be nice to see some more KO; thanks for all your hard work LCF.

  37. holydude June 20th, 2007 1:05 pm

yeah half these anime companys would not be as big as they are now if it wasn’t for the dedication and hard work you subber’s are doing for us. it probly wouldn’t be as big in america since it’s the fans who sub most of this which other people see and most times say hey this is pretty neat and become fans too.
all i can say is a lot of things would be different if it wasn’t for fan subbers and all that?

  38. Furi-Yuri June 20th, 2007 2:12 pm

I sure have been enjoying KO. Thanks for the fansubs.

  39. killerliz June 20th, 2007 8:26 pm

Ic, you are one of the lucky 14 pp who kanna tis letter… …

  40. hotsei June 20th, 2007 10:56 pm

crap.. all crap. can’t have any privacy huh? curses

  41. blue_eyes961 June 21st, 2007 3:57 am

that letter is a load of crap crap crap

  42. Honya-chan June 21st, 2007 4:49 am

I have no problems with long wait, ‘cos if you can handle japanese you don’t need to wait.

  43. mahsah June 21st, 2007 1:33 pm

But not everyone can handle Japanese, and this is the only group subbing this great series.

  44. Honya-chan June 21st, 2007 1:58 pm

then why are you all asking if KO has been dropped. I think if they would have done so, they would also give us hint for that. By the way this would be good place to start studying. ;)

  45. DracoNite666 June 21st, 2007 5:04 pm

pointing out a thing or two from the comments.
    1) copyright is an internationally recognized though the degree of protection may differ from country to country so moving to another country or continent will not help you from dodging the copyright laws.
    2) moving to Africa or some country in Africa is a bad idea, because it really hard to download anime when there is NO FREAKING INTERNET SERVICE! or very limited.
    3) I doubt KO have been dropped because so far they haven’t posted anything. hey it’s summer everyone wants to chill you know

PS state the country you are from when asking question regarding your country. I am in the USA, so info may or may not pertain in other parts of the world.

  46. kofan June 22nd, 2007 12:36 am

can anyone request yourmom to sub ko? yourmom is a very fast fansubbing group, but their site need registration to post and i’m too lazy to register

  47. Nytrax June 22nd, 2007 1:22 am

Copyright is observed in a majority of nations around the world. In fact, many are in trade (WTO) and copyright organizations that have standards they set to join. Each nation has to meet the standards but they may go beyond what the organization requires just as long as the minimum is met. For example, the US has a copyright term of life + 70 years of the last surviving author, one of the copyright organizations we belong to only requires a nation to have life + 50 years.

By belonging to CO it ensures that any copyrighted material produced in your country has a minimum amount of protection in any other country that is a member of the CO. The only nations that I know off the top of my head that aren’t a member of any CO or the WTO are most of the middle east and maybe one or two really really small African countries. So simply running to Canada with all your downloaded anime isn’t going to do you much good if you’re caught.

  48. fan June 22nd, 2007 7:32 am

it would be still nice if they could tell us the status on KO so we wouldnt have to worry if it has been droped or not.

  49. lapantouflemagic June 22nd, 2007 5:52 pm

i don t think they dropped the project but there hasn t been any releases since more than a month, if they were on holydays or anything else it would have been nice to tell us instead of letting us aks ourselves what s going on…

(oh yes, too, i m french, how is my english ? :D )

  50. raidragon June 22nd, 2007 8:34 pm

hmm….personally i don’t like your-mom subs…i know they’re fast…but the quality…..they have destroyed too many great anime like Code Geass and Utawarerumono…..oh well…but i also don’t like fansub who play around with their fans just because they’re the only fansub(ex:Evalpowar on erementar gerad)

  51. shimazaku June 23rd, 2007 5:15 am

they would have said it , if they add drop KO I thing lol

  52. mari June 24th, 2007 1:46 am

haha u guys, they probably cant sub it, the person who actually subb (translate) the videos is probably not avalible for some reason and all the other people are just sitting around cuz they cant do nothing. (no offense) mike june, that was so dumb africa is a country. dont you guys have something else to do other then wait for them to sub, I only came here to look at the comments so far. btw, dont watch a.f.k subs they suck really bad. i dont think they even know japanese, or english.
